General Conditions of Use of the Entel Website and App
1.- Introduction
This document sets out the general conditions of use, hereinafter the "Conditions", which shall govern the access to and use by the user of the website and web application of the following companies:
EMPRESA NACIONAL DE TELECOMUNICACIONES S.A., a company engaged in the business of its corporate name, Unique Taxpayer Registry Number (RUT) No. 92.580.000-7.
ENTEL PCS TELECOMUNICACIONES S.A., a company engaged in the business of its corporate name, Unique Taxpayer Registry Number (RUT) No. 96.806.980-2.
ENTEL CALL CENTER S.A., Unique Taxpayer Registry Number (RUT) No. 96.563.570-K, whose line of business corresponds to Telecommunications Services, domiciled at Avenida del Valle Sur N° 537, district of Huechuraba, Santiago.
Entel reserves the right to periodically review, modify and update the information contained in these Conditions. Such modifications shall take effect from their publication on the respective website, unless current legislation establishes additional formalities or provides for a different regime of entry into force.
2.- Processing of personal data
The entry and submission of personal data in any of the applications or forms of the Website and App is carried out voluntarily by the user, for the purpose of accessing information, benefits, products and services offered by Entel. All information provided by the user or client to Entel, by any means, must be and is presumed to be accurate, true, complete and up to date, notwithstanding which Entel reserves the right to verify its authenticity.

3.- Cookies
In order to provide better browsing conditions, collect statistical information about the use of Entel's site and applications, and deliver personalized commercial communications, whether its own or from third parties, Entel uses cookie technology.

4.- Use of passwords
The use of Entel's private website (Mi Entel) and its App involves linking the client to a user and requires a password for access, which will be freely defined by the client. This will allow the client to have personalized access to Entel's private website and/or the App, being enabled to request services, pay bills, review billing and obtain information about service plans and equipment, among others.
In using this personalized access, the client undertakes to make diligent use of the password and to maintain its confidentiality.
Upon becoming aware of misuse or undesired use of the personal access password, the client must immediately inform Entel.
The client may at any time change their personal access password, for which they must follow the procedure established on the Mi Entel private website or application.
5.- Intellectual property and industrial property
All content or work that the user or client accesses on ENTEL's Websites or application (images, photographs, illustrations, icons, texts, source code, design or any other content element) is protected under national legislation and international treaties on intellectual and industrial property, unless expressly stated otherwise.
The content that Entel has made available on its websites, whether as owner of the content, as beneficiary of a license over it, or content owned by its suppliers, is protected by the current applicable legislation on Intellectual and Industrial Property.
Entel does not grant any license or Intellectual or Industrial Property right over the website or application, or any of their components. The user shall be liable for any damage or harm caused to Entel and/or third parties arising from the legal infringements they incur in relation to the Intellectual or Industrial Property rights of Entel and its suppliers.
The user may not sell, reproduce, distribute, modify, publish or carry out any other similar activity with any content element of the Website, nor use it on any other Internet portal or application, for any purpose.
Every content element, such as articles, publications, news and information published, displayed, transmitted or communicated on the Website, shall be the responsibility of its author or of the person who provided it, in accordance with the laws on intellectual and industrial property. Links to third-party web pages: The Website may contain links and/or references to sites of third-party manufacturers, producers and/or suppliers of goods and/or services. Entel recognizes the corresponding industrial and intellectual property rights in favor of their holders.
6.- Use of Entel's websites and App
When accessing and/or using the Website, whether public or private, or ENTEL's app, the user must comply with current legislation, and undertakes to:
- (i) Not to use the Website, the App and/or its Internet services in an illegal manner or in a way harmful to the rights and interests of Entel or of third parties, or that may in any way damage, disable, overload, deteriorate, slow down or impede the normal use of the Website and the services, the computer equipment or the documents, files and all kinds of content stored on any computer equipment of Entel, of other users or clients, or of any Internet user. In particular, the user undertakes not to commit any of the offenses defined in Law No. 21.459 establishing computer crimes, neither against nor for the benefit of Entel.
- (ii) Not to reproduce, copy, distribute or allow public access to the Website or the App through any form of public communication, nor to transform or modify the services, unless authorization is obtained from the holder of the corresponding intellectual or industrial property rights, or it is legally permitted.
- (iii) Not to remove, circumvent or manipulate the intellectual and industrial property right and other data identifying the rights of Entel or of other holders, incorporated into the services, as well as the technical protection devices, digital fingerprints, biometric authentication measures or any information mechanisms that the services may contain and/or request.
- (iv) Not to infringe the rights of third parties, execute, induce or promote criminal, denigrating, defamatory acts, or acts that in general are contrary to the law, morality, public order, or national security, or that are discriminatory on grounds of sex, race, religion, beliefs, age or condition.
- (v) To respect the privacy of users.
- (vi) Not to use the services for commercial purposes, including the promotion of any good or service.
- (vii) Not to obstruct, hinder, restrict or limit in any way the use of the services by other users.
- (viii) Not to provide information that is not accurate, true, complete and up to date, or that in any way harms Entel or third parties.
- (ix) Not to attempt to contravene or breach the security measures of the Website or the App.
- (x) Not to carry out automated information extraction activities from ENTEL's Website or app through "Web Scraping", "Web Crawling" and "Web Parsing" techniques, nor to use techniques that entail obtaining without authorization confidential data and information of ENTEL, its users, clients or suppliers, creating false or duplicate content of ENTEL's Website or App, and in general, not to carry out activities that may in any way harm ENTEL, its users, clients or third parties. To protect its Website and App, Entel may modify, replace, discontinue or remove, without prior notice, any of the content and/or functionalities offered on the Website and/or its Internet services and App. Entel may exercise this power both with respect to the content and services enabled directly by Entel, and with respect to the content and services enabled by third parties through Entel's sites and App.
Entel does not control, rate or censor the use given by the user to the services and/or Website, but if it determines that the user is accessing the site and/or using its Internet services for a purpose different from the one that served as the basis for its creation, or is in breach of these General Conditions of Use and/or legal provisions, Entel may suspend or revoke, totally or partially, and immediately, the access passwords, access to the site and/or the right to use its Internet services. The revocation may involve the deletion of the information that the user had stored while using the service, the removal of their access passwords and the exclusion of the user from the corresponding records.
In cases where it is possible, Entel will inform the user in advance regarding the application of these measures. Without being exhaustive, it shall be understood that there is no possibility of informing in advance about the application of these measures in cases of force majeure, such as when so requested by a competent authority, or when prior information renders the measure inoperative or reduces its effectiveness.
The services, products and prices advertised through the Website are subject to stock availability and the commercial terms and conditions established by Entel for each service and product. The marketing of goods and/or services by Entel shall be governed by its own and particular terms and conditions, which are available on the respective page of the Website.
Given the special nature of the Internet, which is based on the operation of computer programs and equipment, and telecommunications networks, the Website and the Internet services are subject to the risk of interruptions, errors, failures, congestion or unauthorized interventions.
Entel's Website may contain links to sites maintained by third parties and may eventually provide third-party material from their sites. The functionality, effectiveness of the services and the content of those sites other than its own Website shall be those provided by such third parties.
